Terms of Service

1. Agreement

By creating an account or using HamSel, you agree to these Terms of Service and applicable policies made available through the platform.

2. What HamSel provides

HamSel is a home service operating system. It provides software for managing service requests, jobs, quotes, communication, payments, records, business operations, automation, and related workflows.

HamSel does not itself perform plumbing, electrical, HVAC, handyman, painting, construction, or other home services unless expressly stated otherwise.

3. Accounts

You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and activity performed through your account.

4. Homeowners

Homeowners are responsible for providing accurate information about service needs, property access, hazards, scheduling requirements, and other information reasonably needed to complete a service workflow.

5. Service professionals

Service professionals are responsible for maintaining any licenses, insurance, registrations, permits, qualifications, and business requirements applicable to the services they provide.

Service professionals remain responsible for their work, pricing, representations, tax obligations, employees, subcontractors, safety practices, and compliance with applicable law.

6. Quotes and service agreements

Quotes, estimates, schedules, messages, approvals, and related records may be managed through HamSel. The parties remain responsible for reviewing the details of the service being requested and provided.

7. Payments

HamSel may facilitate payments using Stripe. Payment processing, connected accounts, refunds, transfers, and payouts may also be subject to Stripe's terms and requirements.

Users authorize applicable charges when they approve and submit a payment through the platform.

8. Professional software subscriptions

HamSel may offer free and paid software plans for service professionals. Paid plans may renew automatically according to the billing period and terms presented before purchase.

Subscription features, prices, trials, and plan availability may change over time. Material billing information will be presented before purchase or plan modification.

9. Acceptable use

You may not use HamSel to commit fraud, impersonate another person, distribute malicious software, interfere with platform security, abuse another user, submit unlawful content, obtain unauthorized access, or use the platform for unlawful activities.

10. Safety and emergencies

HamSel is not an emergency response service. If there is an immediate threat to life, safety, property, fire, gas exposure, electrical danger, or another emergency, contact the appropriate emergency service or qualified professional.

11. Intellectual property

HamSel software, branding, interfaces, designs, and platform content are protected by applicable intellectual property laws. These Terms do not transfer ownership of HamSel intellectual property to users.

12. Availability

We work to keep HamSel available and reliable, but we do not guarantee uninterrupted operation. Features may occasionally be modified, suspended, or unavailable because of maintenance, security, provider outages, or other circumstances.

13. Disclaimer

To the extent permitted by law, HamSel is provided on an "as is" and "as available" basis. HamSel does not guarantee the quality, safety, legality, suitability, licensing status, or outcome of services performed by an independent service professional.

14. Limitation of liability

To the maximum extent permitted by applicable law, HamSel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform.

15. Suspension and termination

HamSel may suspend or terminate access where reasonably necessary to protect users, prevent fraud or abuse, comply with law, enforce these Terms, or protect platform integrity.

16. Changes

These Terms may be updated as HamSel evolves. Continued use after an updated version becomes effective may constitute acceptance where permitted by law.
